Terms of Service

1. General Provisions

These Terms of Service (hereinafter "Terms") govern the use of the livecup.app platform (hereinafter "LiveCup" or "Platform"), operated by harbor9.

By creating an account or using LiveCup, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should not use our services.

2. Service Description

LiveCup is a web application that enables:

• Creating and managing sports and esports tournaments (leagues, group stages with playoffs, cup/knockout format)
• Registering teams via QR codes and unique links
• Real-time score tracking and live standings display on TVs and big screens
• Customizing tournament branding, sponsors, and embeddable widgets

3. Registration and Account

To use most features of LiveCup, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate and up-to-date information during registration. LiveCup reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Subscription Plans, Payments and Licensing

LiveCup offers the following subscription plans (prices may be updated; the current pricing is always available at livecup.app/pricing):

• Free — $0. Up to 4 teams per tournament, basic features. The Free plan is provided under a non-commercial license — it may only be used for private, non-profit purposes (e.g. games with friends, informal competitions). Using the Free plan for commercial events (with entry fees, sponsors, or for business promotion) is not permitted.
• Pro — $9/month or $79/year. Up to 32 teams, custom branding, sponsor management, embed widget, operator mode, PDF export, no ads. Includes a commercial license — you may use LiveCup to organize paid or sponsored tournaments.
• Business — $29/month or $299/year. Unlimited teams, all Pro features included. Includes a commercial license.
• Enterprise — individual pricing. Tailored offer for large organizations. Contact [email protected].

In addition to subscriptions, LiveCup offers one-time tournament credits that unlock premium features for a single tournament:

• Single credit — $3 (unlocks premium features for 1 tournament)
• 5-credit pack — $10 (unlocks premium features for 5 tournaments, ~33% savings)

Tournament credits are granted under a non-commercial license — they unlock premium features (custom branding, no ads, embed widget) for individual tournaments, but do not authorize the use of LiveCup for commercial events. To organize commercial tournaments, an active Pro, Business, or Enterprise subscription is required.

All payments are processed securely through Stripe. LiveCup does not store credit card data. Subscriptions renew automatically at the end of each billing period unless canceled. You may cancel your subscription at any time through Account Settings or the Stripe billing portal — access remains active until the end of the current paid period.

5. User Obligations

As a user of LiveCup, you agree to:

• Use the platform in accordance with applicable law and these Terms
• Not upload content that is illegal, offensive, infringing, or violates third-party rights
• Not attempt to gain unauthorized access to other accounts or LiveCup systems
• Not use the platform for purposes other than organizing and managing tournaments
• Not use automated tools, bots, or scripts to interact with the platform without our written consent
• Be responsible for all content you upload, including team logos, sponsor logos, and tournament data
• Not resell access to the platform or its features without our written consent

6. Content and Intellectual Property

All content on LiveCup (code, design, logos, text) is the intellectual property of harbor9 and is protected by copyright. You may not copy, modify, distribute, or use any LiveCup content without our written consent.

Content uploaded by you (team logos, tournament names, sponsor materials) remains your property. By uploading content to LiveCup, you grant us a non-exclusive, worldwide license to display, store, and process this content as needed to provide our services. This license terminates when you delete the content or your account.

7. Public Tournament Data

Tournament data such as team names, match scores, standings, and bracket results may be displayed publicly when you enable public features such as TV mode, embed widgets, or public join links.

As the tournament organizer, you are responsible for informing participants that their team names and match results may be publicly visible. LiveCup is not responsible for any disputes arising from the public display of tournament data.

8. Disclaimer of Warranties

LiveCup is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure access to the platform. We are not responsible for any data loss resulting from technical failures, server issues, or circumstances beyond our control.

9. Limitation of Liability

To the fullest extent permitted by applicable law, harbor9 and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use LiveCup. Our total aggregate liability shall not exceed the amount you paid to LiveCup in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Account Termination

You may delete your account at any time through account settings or by contacting us at [email protected]. Upon account deletion, all your data will be permanently removed in accordance with our Privacy Policy.

LiveCup reserves the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Use the platform for illegal activities
• Abuse the platform or its features in a manner that negatively affects other users

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of LiveCup after changes constitutes your acceptance of the updated Terms. For significant changes, we will endeavor to provide at least 30 days' notice through the platform or via email.

12. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be resolved by the competent courts in Poland, without prejudice to mandatory consumer protection provisions of the country of your habitual residence within the European Union.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
